ALICI: siparişi veren Derby Duel hesabının sahibi. Alıcının kimliği, siparişin bağlı olduğu kullanıcı adı ve ödeme sırasında verilen e-posta adresidir; satıcı alıcıdan ad ya da adres bilgisi TALEP ETMEZ. Telefon numarası, ödeme kuruluşu zorunlu tuttuğu için ödeme sırasında istenir ve istekle birlikte doğrudan ödeme kuruluşuna iletilir; satıcının kayıtlarında yer almaz.

Madde 2 - Konu

Bu sözleşmenin konusu, alıcının ngolo.app üzerinden elektronik ortamda sipariş verdiği, aşağıda nitelikleri ve satış bedeli belirtilen dijital ürünün (oyun içi sanal para birimi 'elmas') satışı ve teslimi ile ilgili olarak tarafların 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri uyarınca hak ve yükümlülüklerinin belirlenmesidir.

Madde 3 - Sözleşme konusu ürün ve bedel

Ürün: Derby Duel oyununda kullanılan sanal para birimi elmas. Paketin adı, içerdiği elmas adedi ve KDV dahil satış bedeli, sipariş sırasında ödeme ekranında gösterilir ve siparişin onaylanmasıyla bu sözleşmenin ayrılmaz parçası hâline gelir. Ödeme tek çekimdir; taksit uygulanmaz. Ayrıca teslimat ya da hizmet bedeli alınmaz.

Madde 4 - Ürünün niteliği

Elmas dijital içeriktir; maddi bir ürün değildir ve gerçek para değildir. Yalnız oyun içinde, yalnız görünüşe ilişkin içerikler (avatar çerçevesi, takma ad rengi, sandık) ve sandık sayacını atlamak için harcanır. Oyundaki kademe, eşleşme, zorluk düzeyi ve soru içeriği elmasla satın alınamaz. Elmas devredilemez, başka bir hesaba aktarılamaz, satılamaz ve paraya çevrilemez.

Madde 5 - Ödeme

Tahsilat, PayTR altyapısı ve bankanın 3D Secure doğrulaması üzerinden yapılır. Kart bilgileri alıcının tarayıcısından doğrudan ödeme kuruluşuna iletilir; satıcı bu bilgilere hiçbir aşamada erişmez ve saklamaz. Ödemenin gerçekleştiğine ilişkin tek geçerli kayıt, ödeme kuruluşundan satıcıya ulaşan imzalı bildirimdir; alıcının tarayıcısının yönlendirildiği sayfa tek başına ödeme kanıtı değildir.

Madde 6 - İfa ve teslim

Satıcı, ödeme onayının kendisine ulaşmasıyla birlikte sipariş konusu elması, siparişin verildiği hesaba derhâl tanımlar. Ayrı bir teslim süresi, yeri ya da bedeli yoktur. Elmasın hesaba tanımlandığı an, satıcının sipariş kayıtlarında saklanır.

Madde 7 - Cayma hakkı

Sözleşme konusu ürün, elektronik ortamda anında ifa edilen ve alıcıya anında teslim edilen gayrimaddi bir mal olduğundan, Mesafeli Sözleşmeler Yönetmeliği'nin 15/1-(ğ) maddesi uyarınca CAYMA HAKKI KAPSAMI DIŞINDADIR. Alıcı, siparişi onaylarken bu istisnayı bildiğini ve ifanın derhâl başlamasına açık rıza gösterdiğini kabul ve beyan eder.

Madde 8 - İade ve düzeltme

Ödeme tahsil edildiği hâlde elmas hesaba tanımlanmamışsa, satıcı önce tanımlamayı yapar; bu mümkün değilse bedeli iade eder. Aynı sipariş için mükerrer tahsilat yapılmışsa fazla tutar iade edilir. Alıcının bilgisi ve rızası dışında yapıldığı anlaşılan işlemler, inceleme sonucuna göre iade edilir. İadeler tahsilatın yapıldığı karta yapılır; tutarın karta yansıması bankaya bağlıdır.

Madde 9 - Alıcının yükümlülükleri

Alıcı, satın alma yapabilmek için kullanıcı adı ve şifre ile açılmış bir hesaba sahip olmalıdır; misafir hesapla satın alma yapılamaz. Alıcı, kendisine ait olmayan bir kartla ya da kart sahibinin rızası olmadan işlem yapmayacağını kabul eder. On sekiz yaşından küçükler, velisinin onayı olmadan sipariş veremez.

Madde 10 - Hesabın kapanması ve hizmetin sona ermesi

Alıcı hesabını sildiğinde harcanmamış elmas da silinir ve bedeli iade edilmez. Oyun kurallarının ihlali nedeniyle kapatılan hesaplarda harcanmamış elmas için bedel iadesi yapılmaz. Oyunun kalıcı olarak kapatılması hâlinde durum, kapanıştan en az 30 gün önce oyun içinde ve ngolo.app üzerinden duyurulur; duyuru tarihinden sonra elmas satışı yapılmaz.

Madde 11 - Kişisel veriler

Sipariş kapsamında işlenen veriler (paket, tutar, tarih, ödeme sırasında verilen e-posta ve isteğin geldiği IP adresi) ve saklama süreleri gizlilik metninde yer alır: ngolo.app/privacy. Sipariş kayıtları, hesap silinse dahi mali kayıt olarak saklanır; kayıtla hesap arasındaki bağ koparılır.

Madde 12 - Delil sözleşmesi

Taraflar arasında çıkabilecek uyuşmazlıklarda satıcının sipariş kayıtları, sunucu kayıtları ve ödeme kuruluşundan gelen bildirim kayıtları delil olarak kabul edilir. Bu hüküm, tüketicinin kanundan doğan delil ileri sürme hakkını ortadan kaldırmaz.

Madde 13 - Uyuşmazlıkların çözümü

Bu sözleşmeye Türk hukuku uygulanır. Uyuşmazlıklarda, Ticaret Bakanlığınca her yıl belirlenen parasal sınırlar çerçevesinde, tüketicinin yerleşim yerindeki ya da işlemin yapıldığı yerdeki tüketici hakem heyetleri ile tüketici mahkemeleri yetkilidir.

Madde 14 - Yürürlük

Alıcı, ödeme ekranındaki onay kutusunu işaretleyip siparişi başlattığında bu sözleşmenin tüm koşullarını okuduğunu, anladığını ve kabul ettiğini beyan etmiş sayılır. Sözleşme, siparişin ödeme kuruluşunca onaylanması ile kurulur ve tarafların yükümlülüklerini yerine getirmesiyle sona erer.

Article 1 - Parties

BUYER: the holder of the Derby Duel account placing the order. The buyer is identified by the username the order belongs to and the email given at checkout; the seller does NOT ask the buyer for a name or address. A phone number is requested at checkout because the payment provider requires it, and it is passed straight to the payment provider with the request; it does not appear in the seller's records.

Article 2 - Subject

This agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the digital product ordered electronically at ngolo.app: the in-game virtual currency 'gems'.

Article 3 - Product and price

Product: gems, the virtual currency used in the game Derby Duel. The pack name, the number of gems it contains and the VAT-inclusive price are shown on the payment screen at the time of the order and become an inseparable part of this agreement when the order is confirmed. Payment is a single charge; no instalments. No delivery or service fee is added.

Article 4 - Nature of the product

Gems are digital content; they are not a physical product and not real money. They are spent only inside the game, only on appearance-related content (avatar frames, nickname colours, chests) and on skipping a chest timer. Rank, matchmaking, difficulty and question content cannot be bought with them. Gems cannot be transferred to another account, sold or exchanged for money.

Article 5 - Payment

Payment is collected through PayTR with the bank's 3D Secure verification. Card details travel from the buyer's browser straight to the payment provider; the seller never accesses or stores them at any stage. The only valid record that payment has taken place is the signed notification the seller receives from the payment provider; the page the buyer's browser is redirected to is not, on its own, proof of payment.

Article 6 - Performance and delivery

The seller credits the ordered gems to the account that placed the order immediately upon receiving the payment confirmation. There is no separate delivery time, place or fee. The moment the gems are credited is kept in the seller's order records.

Article 7 - Right of withdrawal

As the product is an intangible good performed and delivered instantly in electronic form, it is OUTSIDE THE SCOPE of the right of withdrawal under Article 15(1)(ğ) of the Distance Contracts Regulation. By confirming the order the buyer declares that they know of this exception and expressly consent to performance beginning immediately.

Article 8 - Refunds and correction

If payment was collected but the gems were not credited, the seller credits them; if that is not possible, the amount is refunded. If the same order was charged more than once, the excess is refunded. Transactions found to have been made without the buyer's knowledge and consent are refunded according to the outcome of the review. Refunds go back to the card that was charged; the time it takes to appear depends on the bank.

Article 9 - Buyer's obligations

To make a purchase the buyer must hold an account created with a username and password; guest accounts cannot buy. The buyer undertakes not to pay with a card that is not theirs or without the cardholder's consent. People under eighteen may not order without the consent of a parent or guardian.

Article 10 - Account closure and end of service

If the buyer deletes their account, unspent gems are deleted with it and are not refunded. No refund is given for unspent gems on accounts closed for breaking the rules of the game. If the game is shut down permanently, this is announced in the game and at ngolo.app at least 30 days beforehand; no gems are sold after that announcement.

Article 11 - Personal data

The data processed with an order (pack, amount, date, the email given at checkout and the IP the request came from) and its retention are set out in the privacy policy: ngolo.app/privacy. Order records are kept as financial records even if the account is deleted; the link between the record and the account is removed.

Article 12 - Evidence

In any dispute, the seller's order records, server logs and the notification records received from the payment provider are accepted as evidence. This does not remove the consumer's statutory right to submit evidence.

Article 13 - Governing law and disputes

Turkish law applies to this agreement. Disputes may be brought before the consumer arbitration committees and consumer courts at the consumer's place of residence or where the transaction took place, within the monetary limits set each year by the Ministry of Trade.

Article 14 - Entry into force

By ticking the box on the payment screen and starting the order, the buyer is deemed to have read, understood and accepted all terms of this agreement. The agreement is concluded when the order is approved by the payment provider and ends when both parties have performed their obligations.
